2.2 These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on https://www.ducadascalona.com/. 2.3 The products are sold to the Customer identified by the data entered when completing and sending the order form in electronic format with simultaneous acceptance of these General Conditions of Sale.
2.4 The product offers on the website https://www.ducadascalona.com/ are intended for adult customers. By placing an order through the website, you guarantee that you are 18 years of age or older and have the legal capacity to enter into binding contracts.

3. Sales via e-commerce service
3.1 An online sales contract means a distance contract for the sale of movable goods (hereinafter Products) entered into between the Customer and Duca D'Ascalona SRL, as part of an e-commerce service organised using the Internet.
3.2 To conclude the purchase contract for one or more Products, you must complete the order form in electronic format (hereinafter the Order) and send it to Duca D'Ascalona SRL via the internet by following the relevant instructions.
3.3 The General Conditions of Sale can be found on the website xhttps://www.ducadascalona.com/; information and images of each Product and the relative price; the payment methods to be used; the delivery methods of the purchased Products and the relative shipping and delivery costs; the reference to the conditions for the right of withdrawal; the methods and times for returning the purchased products.
3.4 Although Duca D'Ascalona SRL constantly takes measures to ensure that the photographs displayed on the website are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution of the computer used by the Customer. Consequently, Duca D'Ascalona SRL will not be responsible for any inadequacy of the graphic representations of products displayed on the website due to the aforementioned technical reasons, since such representations are merely for illustrative purposes.
3.5 Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when Duca D'Ascalona SRL receives the Order Form, after verifying the accuracy of the data relating to your order.
3.7 The language available for concluding the contract with Duca D'Ascalona SRL is Italian and the applicable law is Italian law.
3.8 Upon conclusion of the contract, Duca D'Ascalona SRL will take charge of the order for its fulfillment.
4. Order Evasion
4.1 By submitting the Order Form, you unconditionally agree to abide by these General Conditions of Sale in your dealings with Duca D'Ascalona SRL.
4.2 Once the contract has been concluded, Duca D'Ascalona SRL will send an Order confirmation by email, containing a summary of the information.
4.3 Duca D'Ascalona SRL reserves the right to request further information regarding the Order sent before sending the Order confirmation.
4.4 Duca D'Ascalona SRL may not process purchase orders that do not provide sufficient guarantees of solvency, are incomplete, or incorrect, or if the products are unavailable. In these cases, the Customer will be informed that the contract has not been concluded and that Duca D'Ascalona SRL has not fulfilled the Order, specifying the reasons. In this case, the amount held on the Customer's payment method will be released.
4.5 If the products on the website https://www.ducadascalona.com/ are no longer available or on sale after the Order has been placed, Duca D'Ascalona SRL will promptly notify the Customer, and in any case within thirty (30) working days from the day after the order is sent to Duca D'Ascalona SRL, of the unavailability of the ordered Products. In this case, the amount held on the Customer's payment method will be released.
4.6 Duca D'Ascalona SRL undertakes to deliver the ordered products to the Customer within and no later than 30 days from the date of conclusion of the contract.
4.7 Each sale made by Duca D'Ascalona SRL through the online sales service may concern one or more products, with no quantity limit for each item.
4.8 Duca D'Ascalona SRL reserves the right to refuse orders from customers with whom it is involved in a legal dispute regarding a previous order. This applies equally to all cases in which Duca D'Ascalona SRL deems the customer unsuitable, including, but not limited to, previous violations of the terms and conditions of the online purchase contract on the site or for any other legitimate reason, especially if the customer has been involved in fraudulent activity of any kind.
5. Sales prices
5.1 Unless otherwise specified in writing, all Product prices and shipping and delivery costs listed on the website and in the Order are inclusive of VAT and expressed in euros. Product prices and shipping and delivery costs may change without notice. In this case, the date of dispatch of the relevant Order will prevail.
5.2 All Products are shipped directly from Italy. Product prices and shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, do not include any costs related to customs duties and related taxes, which cannot be calculated in advance, if the shipment is to non-EU countries or to countries where applicable legislation provides for import duties. In this case, the existence of any additional costs indicated above will be clearly mentioned during the Order entry and review phase, it being understood that the precise amount of such costs will be communicated by the carrier to the Customer upon delivery of the products.

12. Applicable law, dispute resolution and competent court
These General Terms and Conditions of Sale are governed by and will be interpreted in accordance with Italian law, without prejudice to any other mandatory prevailing law of the Customer's country of habitual residence. Consequently, the interpretation, execution, and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law, and any disputes arising from or related to them shall be resolved exclusively by Italian jurisdiction. Specifically, if the Customer is a consumer, any disputes shall be resolved by the court of their domicile or residence in accordance with applicable law, or, at the consumer's discretion, in the event of an action brought by the consumer. If the Customer is acting in the exercise of their business, commercial, artisanal, or professional activity, the parties agree that the Court of Macerata shall have exclusive jurisdiction.
